Terms and Conditions

These Terms and Conditions (the “Terms”) apply to all orders placed through OLFACTOPRIVE.CH, operated by Ounissi Trade.

By placing an order through our online store, you acknowledge that you have read and accepted these Terms and Conditions.

1. Scope of Application

These Terms and Conditions govern the contractual relationship between:

hereinafter referred to as “OLFACTOPRIVE.CH,” “we,” “us,” or “our,”

and any person making a purchase through OLFACTOPRIVE.CH, hereinafter referred to as “the customer,” “you,” or “your.”

These Terms and Conditions apply to all orders placed through our online store.

3. Products and Authenticity

We offer, among other things, perfumes, niche fragrances, cosmetics, and related lifestyle products.

We are committed to offering authentic and genuine products.

Our goods are purchased from established professional suppliers and business partners in Europe. Our sourcing is carried out through regular and documented commercial transactions.

We retain invoices and commercial documents relating to our purchases in order to ensure the traceability of our goods.

Goods intended for our business activities in Switzerland are imported in accordance with applicable procedures and undergo Swiss customs formalities where required.

4. Prices and Payment Methods

All prices displayed on our website are stated in Swiss francs (CHF).

Applicable Swiss VAT is included in the prices where VAT is due.

Any applicable shipping costs are displayed separately before the order is confirmed.

The payment methods available are those displayed during the checkout process.

Payment is due at the time the order is placed.

We reserve the right not to ship an order until payment has been confirmed.

5. Formation of the Contract

By clicking the order button or any equivalent button clearly indicating that the order entails an obligation to pay, you place a binding order for the selected products.

Automatic receipt of your order does not necessarily constitute final acceptance of the order.

The sales contract is concluded when we send you an order confirmation by email, subject to product availability.

In the event of an obvious pricing error, technical error, exceptional product unavailability, or any issue preventing us from fulfilling the order, we reserve the right not to accept or to cancel the relevant order.

In such cases, any amounts already paid for the affected order will be refunded.

6. Order Cancellation

You may contact us to request cancellation of an order provided that the order has not yet been prepared or shipped.

We will make reasonable efforts to accommodate your request.

Once order preparation or shipping has begun, cancellation may no longer be possible. In this case, the provisions of our Return Policy shall apply.

Sale items, clearance items, limited editions, or products subject to special offers may be subject to specific conditions, subject to any mandatory rights provided by law.

7. Shipping

🇨🇭 Shipping Exclusively Within Switzerland

We ship only within Switzerland.

All orders are prepared and shipped from Switzerland.

We currently do not offer international shipping.

Same-Day Dispatch

Orders placed Monday to Friday before 3:00 PM are generally prepared and dispatched the same day, subject to product availability and operational conditions.

Orders placed after 3:00 PM, on weekends, or on public holidays are generally processed on the next business day.

No Customs Charges Upon Delivery

Since orders are shipped from Switzerland, customers have no customs procedures to complete and will not be charged additional customs duties upon receiving their order.

Any applicable shipping costs are clearly displayed before the order is confirmed.

Delivery times provided are estimates and may vary depending on the carrier, destination, public holidays, weekends, or circumstances beyond our reasonable control.

8. Returns

We offer a 30-day return period from the date of receipt of the order, subject to the conditions below.

Perfumes

A perfume may be returned within 30 days only if it is:

New and unused;
Unopened and untested;
Still sealed in its original packaging;
Intact and undamaged.

For hygiene and safety reasons, opened, unsealed, or tested perfumes cannot be returned voluntarily.

Cosmetics and Lifestyle Products

Cosmetics and lifestyle products may be returned within 30 days provided that they are:

Unused;
Unworn;
Undamaged;
In their original packaging.

Return Shipping Costs

For a voluntary return, return shipping costs are the responsibility of the customer.

We recommend using a shipping service that provides tracking.

Items Excluded from Voluntary Returns

The following items are excluded from voluntary returns:

Opened, unsealed, or tested perfumes;
Samples;
Discovery Sets;
Used, worn, or damaged products;
Sale or clearance items;
Limited-quantity items;
Products subject to a special promotional offer.

These exclusions do not affect any applicable statutory rights in the event of a defective, damaged, or incorrectly delivered product.

9. Promotional Free Items

When we offer a free product, such as a sample or Discovery Set, as part of the purchase of a main product, the free item is linked to that order.

If the relevant main product is returned, the free item must also be returned:

Complete;
Unopened;
Unused;
Undamaged.

If the free item is not returned, or is returned opened, incomplete, or damaged, its retail value stated at the time of purchase may be deducted from the refund amount, to the extent permitted by applicable regulations.

We recommend contacting our customer service before making any return in order to receive the necessary instructions.

11. Damaged Products or Incorrect Delivery

We encourage you to check your order upon receipt.

If you notice that your parcel is damaged, a product is defective, or an item received does not correspond to your order, please contact us as soon as possible at:

Please include your order number and, where possible, photographs of the parcel and the product concerned.

We will review your request and provide you with the applicable procedure.

Any statutory warranty rights remain reserved.

12. Warranty

Warranty rights provided under applicable Swiss law remain reserved.

The warranty does not cover, in particular, damage resulting from improper use, mishandling, use contrary to the manufacturer's instructions, or normal wear and tear, to the extent permitted by law.

Any additional warranties provided by a manufacturer or expressly by OLFACTOPRIVE.CH remain unaffected.

13. Promotions and Discounts

Promotions and discounts are valid only for the period and under the conditions stated on our website.

Unless otherwise stated, promotions cannot be combined.

Certain products, brands, or categories may be excluded from promotions.

We reserve the right to modify, suspend, or terminate a promotion in the event of a technical issue, misuse, or for any other operational reason.

No promotion creates an entitlement to the same offer for future orders.

14. Liability

We take the greatest possible care to ensure the accuracy of the information published on our website.

However, we cannot be held liable for damages resulting, in particular, from improper use of a product, use contrary to the manufacturer's instructions, or use that does not correspond to the intended purpose of the product, to the extent permitted by law.

Any exclusion or limitation of liability does not apply where such exclusion or limitation is prohibited by mandatory applicable law.

15. Orders by Minors

Orders placed by minors must comply with the applicable rules regarding legal capacity.

Where the consent of a legal representative is required, such consent must be obtained before the contract is concluded.

16. Intellectual Property

All content available on OLFACTOPRIVE.CH, including texts, photographs, images, descriptions, logos, graphic elements, designs, and layouts, is protected under applicable intellectual property laws.

Any reproduction, modification, distribution, copying, or use without prior authorization is prohibited, except where permitted by law.

Trademarks and logos belonging to their respective owners remain the property of those owners.

17. Data Protection

We process personal data in accordance with applicable Swiss data protection legislation.

Information regarding the data we collect, how we use it, cookies, service providers, and the rights of individuals concerned is detailed in our Privacy Policy.

18. Retention of Title

The goods remain the property of Ounissi Trade until the purchase price has been paid in full.

We reserve the right to register a retention of title in the competent register where legally permitted.

19. Commercial Resale

Products purchased through OLFACTOPRIVE.CH are intended for private use.

Professional resale, redistribution, or any other commercial exploitation of products purchased through our website is not permitted without our prior written consent.

20. Electronic Communications

You agree that communications relating to your order and the sales contract may be carried out electronically, including by email.

You are responsible for providing a correct and functioning email address and ensuring that our communications can reach you.

Electronic communications are considered received when they become accessible in the recipient's inbox, subject to any mandatory legal provisions.

21. Applicable Law and Jurisdiction

These Terms and Conditions and the contractual relationship between the customer and Ounissi Trade are governed by Swiss law, subject to any applicable mandatory provisions.

Subject to mandatory rules regarding jurisdiction, the place of jurisdiction is located in Switzerland.

To the extent permitted by law, the competent courts at the registered office of Ounissi Trade shall have jurisdiction over any disputes.

22. Severability

If any provision of these Terms and Conditions is declared invalid, illegal, or unenforceable, the remaining provisions shall remain fully valid.

The affected provision shall, to the extent permitted by law, be replaced by a valid provision that comes as close as possible to the economic purpose of the original provision.

23. Amendments to the Terms and Conditions

We reserve the right to amend these Terms and Conditions where necessary.

The version of the Terms and Conditions in force at the time the order is placed shall apply to the relevant contractual relationship.

Amendments shall not apply retroactively to contracts already concluded, unless required by law.
